Lack of regulation keeps access to beaches in Los Cabos uncertain

Ensuring free access to beaches in the municipality of Los Cabos remains a challenge involving legal, social, and land-use planning aspects, particularly in areas where private properties converge. Authorities acknowledge progress in planning, but also the need to reach agreements in Los Cabos.

In this context, during his recent visit to the municipality, the Director General of the Federal Maritime Terrestrial Zone (ZOFEMAT), Alfredo Arellano, addressed the challenges and strategies being implemented to consolidate legal and orderly access to the beaches.

“We are looking at different options for creating access points. There is a lot of diversity: some are official, where the property is public and we don’t encounter any problems; however, there are others where access was granted based on custom and tradition, but it lacks legal standing.”

In these privately owned areas, “we have to proceed step by step,” Arellano stated, in order to establish clear access in suitable locations that guarantee accessibility for everyone.

Generating these agreements is necessary, the official commented, since there are no federal resources available to expropriate or compensate for all coastlines to eradicate real estate or hotel projects.

There is progress, the official affirms.

“We will gradually advance in identifying and communicating with the community so they know where they can access beaches. We are working on assessments and on ways to reach agreements with users to ensure order.”

He acknowledged that in the municipality of Los Cabos, “in terms of planning and management,” significant progress has been made in guaranteeing beach access for citizens. He noted that this “could be a model for other municipalities to follow.”
